Domestic Violence - Client Found Not Guilty
Appeared on behalf of a client who was accused of assaulting his ex-wife whilst picking up his son from her residence.
The alleged victim was supported by her mother who also gave evidence that the client assaulted the alleged victim.
Careful cross-examination of the alleged victim and her mother brought out inconsistencies within their own evidence and between each other.
The police officers were also cross-examined to adduce evidence favourable to the defence case and to cast further doubt over the legitimacy of the alleged victim’s complaint.
The Magistrate accepted our submissions that he could not find the offence proved beyond reasonable doubt and the client was found “not guilty” and the charge dismissed.
